Doe v. US Department of Defense

Status: Open

Outcome: Pending

Location: Maryland

Jurisdiction + Case Number: U.S. District Court for the District of Maryland

For nearly a decade, the military health system and TRICARE insurance program has provided and covered medically necessary medications for transgender adolescence and young adults. The Department of Defense (DoD) reversed their policy and created a categorical coverage exclusion for and banned military hospitals and clinics from providing this care. If allowed to continue, this policy will deny medically necessary treatment to these young adults of military families, forcing them to pay for the full cost of care and travel off base to receive it.

On behalf of a group of young adults from military families, NCLR, along with GLAD Law, Brown, Goldstein, & Levy, and Keker, Van Nest & Peters, initiated a challenge to the ban on September 8th, 2026.
